JUDGMENT T-218 OF 2022: LEGAL PROGRESS TO STOP HORMONAL DEVELOPMENT WITH UNDERAGE TRANSGENDER PEOPLE

Abstract
The case is presented in Judgment T 218 of 2022, of the Constitutional Court, based on the formulation of a problem question on the subject inquiring about the deficit of legal instruments in the Colombian State so that transgender people can access to the reaffirmation of gender, due to the existence of the fundamental rights of the Political Constitution to the free development of the personality, the fundamental right to health and the fundamental right to human dignity. Correspondingly, the study uses the conformal interpretation method, which is specialized in legal matters that review compliance with human rights. Indeed, the Court’s call to the Ministry of Health and Social Protection to issue a clinical practice guideline that guarantees comprehensive health care for transgender people, such as blocking puberty through hormonal treatments.
