Abstract

The Ibero-American Code of Judicial Ethics establishes that the impartial judge is the one who pursues the truth of the facts with objectivity and based
on proof. In understanding the purpose of the ex officio test, you must have clear basic aspects about the validity of this test; A contradiction is required, either by the plaintiff or by the defendant, and most importantly, that the ex officio test is conducive and relevant for it to be concretely applicable in a specific case. The purpose of the informal evidence is related to the need for it, it will be absolutely necessary when the purpose is to clarify the facts that are the subject of the dispute, of course, for the decree and assessment of it there must be an evident evidentiary insufficiency . To the evidentiary insufficiency must be added the evidentiary dose, whose relationship has to do with the absolute relevance of the evidence and its demonstrative capacity. la cui relazione ha a che fare con l’assoluta rilevanza del test e la sua capacità dimostrativa. Le prove d’ufficio nel processo giudiziario hanno una relazione diretta con i principi del diritto probatorio, ad esempio: per quanto riguarda l’efficacia delle prove possiamo vedere che le prove informali hanno una connotazione con le altre prove esistenti e che sono regolate in nel nostro sistema legale, tutte le prove devono essere orientate per dimostrare le ipotesi fattuali che supportano gli effetti legali che sono destinati a scatenare.
